2. The petitioner apprehends his arrest in connection with Uphara P.S Case No. 117 of 2025 registered for the offences punishable under Sections 30(a) of Bihar Excise Prohibition and Amendment Act.

3. As per the prosecution case, total 8 litre illicit liquor were recovered from the open place.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.85743 of 2025(2) dt.18-12-2025 2/2 for bail of the petitioner.

6. From perusal of the F.I.R., seizure list, impugned order and materials available on record it appears that petitioner was not caught on the spot and no incriminating articles has been recovered from the conscious possession of the petitioner rather the illicit liquor were recovered from the open place, which does not belongs to the petitioner.

7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. II, Aurangabad in connection with Uphara P.S Case No. 117 of 2025 subject to the condition laid down under Section 482(2) of B.N.S.S.
