2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 307 and 379 of the Indian Penal Code.

3. Allegation in the first information report is that the petitioner was unloading sand in front of the gate of the house of the informant which was protested by the informant whereafter the petitioner assaulted the informant on her head and other accused persons also abused and indulged in scuffle.

4. Learned counsel for the petitioner submits that as a matter of fact, no such occurrence had occurred and there was only a hot exchange of words between the parties due to land dispute and local politics. So far as the injury is concerned, no injury report has been brought on record by the informant or has

Patna High Court CR. MISC. No.2641 of 2025(5) dt.07-08-2025 2/2 been found during the entire course of investigation. Rather, an application has been filed before the police which also indicates that there is no injury report on record.

5. Learned APP for the State has opposed the application for anticipatory bail.

6. Considering all the above mentioned facts and circumstances, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Salimpur P.S. Case No. 173 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
