The petitioner seeks bail in connection with Kurtha P.S. Case No.30 of 2002 registered for the offence under Section 409 of the Indian Penal Code. Later on, chargesheet was submitted under Section 406 of the Indian Penal Code. The accusation against the petitioner is that the petitioner was entrusted Rs.57,500/- on 30.05.2000 for construction of drainage, but the petitioner did not complete the construction work. Subsequently, the petitioner was directed to deposit the amount received by him but he did not return the said money.
Learned counsel for the petitioner submits that the petitioner has already constructed the drainage work, for which
Patna High Court CR. MISC. No.82382 of 2019(2) dt.12-12-2019 2/2 he had requested to call for a report from the Block Development Officer about completion of drainage work by the petitioner, but no report was called for by the police and the petitioner has been implicated in the present case on false accusation. The petitioner is in jail since 26.08.2019. The petitioner has already remained in jail for about 3 1⁄2 months. Considering the fact that the petitioner has already constructed the drainage work and he remained in jail for about 3 1⁄2 months, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Arwal in connection with Kurtha P.S. Case No.30 of 2002.
