The petitioner seeks bail in Palasi P.S. Case No.313 of 2017 registered under Section 30 (a)/36/38 of the Bihar Prohibition and Excise Act, 2016.

192 liters of Eskuf syrup is said to have been recovered from the Scorpio of one co-accused parked at his door. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He has no concern with the seized cough syrup or with the said vehicle. He was not apprehended on the spot. He has no criminal antecedent. He has been languishing

Patna High Court Cr.Misc. No.12754 of 2018 (02) dt.06-03-2018 2/ 2 in custody since 13.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Special Case No.3105 of 2017, arising out of Palasi P.S. Case No. 313 of 2017.
