The petitioner is languishing in custody since 12.10.2018 in a case registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 4/6 of Protection of Children from Sexual Offences Act, 2012. Accusation against the petitioner is of ravishing five years old daughter of the informant.

It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been roped in the present case.

However, learned APP submits that four witnesses have already been examined and the trial is in advance stage. Considering the nature of accusation and the fact that

Patna High Court CR. MISC. No.87440 of 2019(3) dt.19-03-2020 2/2 the trial is in advance stage, this Court is not inclined to grant bail to the petitioner in connection with Mahila P.S. Case No. 109 of 2018, pending in the Court of learned A.D.J. Ist, Nalanda at Biharsharif.

Accordingly, the prayer for bail of the petitioner is rejected.

It is expected from the learned trial Court to conclude the trial within a period of nine months.
