Petitioner, who retired from service on 31.01.2018 from the office of Executive Engineer, Irrigation Mechanical Divisional, Balmiki Nagar, Motihari and prays for his pension and arrears of pension with statutory interest, which has not been paid to him even after ten years of his retirement. Petitioner retired on 31.01.2008.

A counter affidavit has been filed on behalf of the respondents stating therein that since charge had not been handed over by the petitioner and some dues were recoverable now no dues certificate has been issued and all calculation of pension has been sent to the Treasury Officer, Purnea after deduction of the amount sought to be recovered. Considering the submission of the learned counsel for

Patna High Court CWJC No.3713 of 2018(3) dt.13-12-2018 2/2 the State, this writ application is disposed of with a direction to the petitioner to appear before the Treasury Officer, Purnea and all admissible amount would be deposited by the Treasury Officer, Purnea in the Bank account of the petitioner within a period of two months from the date of receipt/production of the copy of the order.
