This is a petition for grant of regular bail in connection with Chapra Muffasil P.S. Case No. 341 of 2017 for offences under Sections 504 and 506 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. Allegation, in brief, is that the petitioner was apprehended by the police with country made pistol and five live cartridges.
The learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case by his former accomplice as he had left the criminal activities whereas the learned counsel for the State submits that besides the present case the petitioner has three criminal cases of serious nature, all are under Section 392 of the Indian Penal Code.
Patna High Court Cr.Misc. No.14077 of 2018(2) dt.09-03-2018 2/2 Having considered the facts and circumstances, the prayer for bail of the petitioner is rejected for the present. The petitioner may renew prayer of bail after six months, if trial does not conclude.
