1. Heard learned counsel for the petitioner, Mr. Ganesh Prasad Singh, learned A.P.P. for the State and Mr. Kumar Dhananjay Singh, learned counsel appears on behalf of the person on whose complaint, the FIR was instituted by the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and is the Executive Officer of Nagar Panchayat, Jagdishpur. It is further submitted that K.P. Sahu @ Kedar Prasad Sahu and Ajay Thakur @ Ajay Kumar Thakur had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 29024 of 2025 and Cr. Misc. No. 32860 of 2025 and both the aforesaid criminal miscellaneous
Patna High Court CR. MISC. No.90248 of 2024(6) dt.12-09-2025 2/3 were allowed vide order dated 13.08.2025.
4. Learned counsel for the petitioner next submits that the case of the petitioner is on a similar footing, thus, based on parity seeks anticipatory bail. It is also submitted that in sum and substance, the informant, in the FIR, alleges that accused persons including the petitioner misappropriated public money to the tune of Rs.23,66,000/- entrusted to them for consideration of RCC Drain and PCC Road. It is submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the order dated 13.08.2025 passed in Cr. Misc. No. 29024 of 2025 and Cr. Misc. No. 32860 of 2025, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case
