====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 341, 354(B) of the IPC and 37(C) of Bihar Prohibition & Excise Act, 2016.

The prosecution story, in brief, is that on 07.10.2019, the petitioner in drunken state entered into the house of the informant, abused and misbehaved with her.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 08.10.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the

As per the F.I.R., the petitioner, in drunken state, entered the house of the informant and tried to misbehave with her. Except for this, there is no other allegation made against the petitioner. There is no recovery of liquor from possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IIcum-Special Judge, Excise Act, Nawada, in connection with Akbarpur P.S. Case No. 439 of 2019.
