The petitioners seek regular bail in connection with Nawada Nagar (Kadirganj) P.S.Casae No.1209 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioners is about recovery of 40 ltrs. of bear from the motorcycle of the petitioners. Submission of the learned counsel for the petitioners is that the motorcycle does not belongs to the petitioners, having no criminal antecedent and they are in custody for more than two months. Charge-sheet has been submitted.

Heard learned A.P.P. also.

No.80390 of 2019(2) dt.09-12-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ II cum Special Judge Excise Act, Nawada in connection with Nawada Nagar (Kadirganj) P.S.Case No.1209 of 2019.

With the aforesaid observation, this application is allowed.
