Petitioner seeks bail in a case registered for the offences punishable under Sections 420 of the Indian Penal Code and 138 of N.I. Act.

The complainant had advanced Rs. Nine Lacs as cash to the petitioner for business purpose. The petitioner issued refund cheque of the aforesaid amount which bounced.

Submission is that there is no proof of payment of such a huge amount in cash. So far allegation under Section 138 of the Negotiable Instruments Act is concerned, the same is bailable.

Patna High Court Cr.Misc. No.21620 of 2018 (2) dt.18-04-2018 Considering the aforesaid circumstance, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Complaint Case No.1514 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
