JUSTICE MADHURESH PRASAD ORAL ORDER 27-04-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 341, 342, 323, 376, 504 and 506 of the IPC. Learned counsel for the petitioner submits that the petitioner has been implicated in the instant case on the basis of false allegation at the behest of rival Nursing Home with whom there is litigating terms. He further submits that the age of the victim has been assessed as 19 years. Prior to the lodging of this case, he is accused in two other cases mentioned in paragraph 3 of the bail application.

This Court finds that the medical evidence shows that the victim girl is aged about 17 years. Petitioner is in custody in connection with this case since 14.11.2017. Considering the gravity of the allegation, this Court is not inclined to grant bail to

Patna High Court Cr.Misc. No.17047 of 2018 (3) dt.27-04-2018 the petitioner for the present. The prayer for bail of the petitioner is rejected.
