The petitioners apprehend their arrest in Rupauli P.S. case No. 272 of 2017 for the offences punishable under Section 327,387, 379 and some other Sections of the Indian Penal Code.
The informant alleged that he has put construction material on his land situated by the side of land of petitioners. A Jalebi tree of petitioners had fallen on the land of informant and when the informant asked the petitioners to take away branches of tree from the land of informant the petitioners are alleged to have abused the informant and demanded Rs. 4,00000/- for allowing the informant to construct boundary wall.
Patna High Court Cr.Misc. No.17471 of 2018 (2) dt.05-04-2018 2/2 The learned counsel for the petitioners submits that on account of land dispute some verbal altercation took place between two sides but the informant lodged the case making false allegation of demand of extortion and assault. The case has already been compromised.
Taking into consideration the fact that there appears that both sides on account of land dispute entered into verbal altercation, the petitioners above named in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Purnea in connection with Rupauli P.S. case No. 272 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
