Petitioner seeks bail in a case registered for the offence punishable under Section 396 of the Indian Penal Code. Submission is that though some other accused persons are named in the FIR registered for the offence under Section 396 of the Indian Penal Code. The petitioner is not named therein. Name of the petitioner has surfaced in the confessional statement of co-accused, namely, Amresh Sharma. Petitioner is in custody since 30.10.2017. Petitioner was never put on TI Parade nor anything has been recovered from his possession. The investigation of the case is already complete and the petitioner is ready to cooperate with the trial.

Considering the aforesaid submission, let the

No.17185 of 2018 (2) dt.28-03-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kako Police Station Case No. 07 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
