JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bhagwan Bazar P.S. Case No. 135 of 2016 for the offences punishable under sections 188, 406 and 379 of the I.P.C and sections 40/11 (A) of the Mines Rules.

Allegedly, the truck bearing registration no. BRO4D9351 of the petitioner was caught loaded with illegal sand and the driver did not produce any paper and he stated the name of the petitioner.

Submission is of false implication and that the petitioner has got no knowledge about loading of sand on the

Patna High Court Cr.Misc. No.16834 of 2018 (2) dt.05-04-2018 2/2 truck, the said truck was being driven by the driver, without giving any information to the petitioner, he got loaded the sand and the said driver has been released on bail by the police itself and as such the petitioner deserves sympathetic consideration. The learned A.P.P. submits that the petitioner is the owner of the said truck.

In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Chapra, Saran in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
