Earlier the prayer for bail of the petitioner was rejected by this Court on merit, vide order dated 05.07.2017 passed in cr. Misc. No.19572 of 2017.

Submission of the learned counsel for the petitioner is that he is in custody for about 1 1⁄2 year and there is no repetition of blow and the assault is by lathi. It is submitted by the learned counsel for the petitioner that she died due to some ailment. Heard learned A.P.P. and the learned counsel for the informant..

Having heard both sides and in view of considering the period of custody, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five

Patna High Court Cr.Misc. No.18446 of 2018 (2) dt.11-04-2018 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, Samastipur in connection with S.Tr. No.669 of 2016 (Arisnig out of Mohiuddin Nagar P.S.Case no.139 of 2016), with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
