2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 498(A) and 494 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

3. The case of the prosecution is that the complainant was married to the petitioner in year 1998. It is alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand of a bike and Rs. 50,000/-. It is also alleged that the petitioner solemnized another marriage on 28.08.2020.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that as far as second marriage is concerned, this is not admitted by him. He has not solemnized another marriage. As far as demand is concerned, it has been submitted that the marriage was solemnized in the year 1998 and this case has been filed in year 2020 this amply shows that there was no demand. It has also been submitted that a daughter has born out of that wedlock. During course of hearing, learned counsel for the petitioner has submitted that he is ready ready to settle the matter with the complainant. Moreover, the petitioner is languishing in judicial custody since 20.10.2025.

5. Learned counsel for the complainant is present and has submitted that he is ready to settle the matter.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with C.R. No. 356 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jhanjharpur, Madhubani.

7. Learned trial court is directed to send this case for mediation so that parties may settle their case amicably and take report thereof.
