====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 23-01-2024 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek regular bail in connection with Sikandra P.S. Case No.91 of 2023, registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
3. As per the prosecution case, the daughter of the informant was killed by accused persons including the petitioners due to non-fulfillment of dowry.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case due to the reason that they are the father-in-law and mother-in-law of the deceased. He further submits that from

No.598 of 2024(2) dt.23-01-2024 2/3 perusal of the F.I.R., it appears that the marriage of the deceased with the co-accused Punit Singh was solemnized in the year 2011 and the informant's daughter died in the year 2023, therefore, no offence is made out under Section 304(B) of the I.P.C. He also submits that the police after investigation has filed the charge sheet under Section 498(A), 306/34 of the I.P.C. against the petitioners and there is no chance of absconding the petitioners or tampering with the evidence. Learned counsel submits that petitioners are old aged persons having one criminal antecedent in which they have been acquitted. He further submits that husband of the deceased is already in custody and the petitioners are in custody since 07.09.2023. He also submits that due to some misconception the informant has filed the present case, however, after knowing the true facts he filed the petition before the Court concerned stating that the accused persons are innocent.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioners.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two
