2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(c) and 21(b) of the NDPS Act.

3. The case of the prosecution is that from one coaccused, namely, Md. Sanowar altogether 50.63 grams of smack was recovered. On being asked, he disclosed that he was going to hand over the smack to this petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Nothing has been recovered from the possession of this petitioner and from, the recovery of smack was made has already been granted bail by learned co-

Patna High Court CR. MISC. No.86257 of 2025(2) dt.17-12-2025 2/2 ordinate Bench of this Court vide order dated 10.09.2025 passed in Cr. Misc. No. 64115 of 2025. Moreover, the petitioner is languishing in judicial custody since 08.09.2025. The case of this petitioner stands on better footing.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Korha P.S. Case No. 114 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (NDPS Act), Katihar.
