JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Kishanpur P.S. Case No. 22 of 2018 dated 21.01.2018 instituted for the offences under Sections 341, 323, 384, 379, 504, 506, 34 of the Indian Penal Code. The petitioners are said to have accosted the informant by telling him that before any project is started in the Ward, he ought to be paid Rs. 1,00,000/-(one lakh) and for not having done so, the informant was assaulted by the petitioners.

The learned counsel for the petitioners has submitted that an absolutely false and concocted case has been lodged

Patna High Court Cr.Misc. No.21481 of 2018 (2) dt.26-04-2018 2/2 against the petitioners. No such occurrence ever took place as has been narrated in the F.I.R. The informant is the Chairman of Vidyalaya Shiksha Samiti, Middle School, Sripur whereas the wife of petitioner No. 1 was, at some point of time, Secretary of that Samiti. In the year, 2017, a new committee had to be nominated for which a dispute arose between the petitioners and the informant. There is no injury of any kind on the person of the informant and but for Sections 384 and 379 I.P.C, all other offences are bailable in nature.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 22 of 2018.
