The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 467, 468, 471, 419, 420, 120 (B) of the Indian Penal Code. Prosecution case in brief is that the complainant executed sale deed by the purchase money has not been paid by the petitioner. It is further alleged that the acceptance has not been done by the complaint but accepted being forgery and from standing of others.
Learned counsel for the petitioner submits that the petitioner is innocent and is named in the FIR. It has been submitted that this case based on complaint and there is no specific allegation against the petitioner. On 17.07.2015
Patna High Court CR. MISC. No.734 of 2020(3) dt.24-02-2020 2/2 informant executed sale deed on the payment of Rs. 42,000/- in favour of the petitioner. The said amount was full consideration money. When he came to know that he sold his land in cheaper rate and some one is giving huge amount, he again executed a sale deed on 21.11.2015 in favour of one Surendra Prasad for the same land which was already sold to petitioner. There is civil dispute and the petitioner has got no criminal antecedent In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case No. 331 of 2015, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
