2. The petitioner seeks regular bail in connection with Basantpur (Lakdinabiganj O.P.) P.S. Case No 451 of 2022 lodged on 25.09.2022 under Sections 406/409/420/34 of the Indian Penal Code.

3. As per the F.I.R., four named persons were made accused including the petitioner against whom the allegation is that all the accused persons even after taking money from the Government Exchequer have not completed the work.

4. The learned counsel for the petitioner submits that the petitioner was working as a Ward Secretary of Ward No. 9 and, according to him, the work of Nal Jal Yojana has already been completed and nothing has been left. This Court has called

Patna High Court CR. MISC. No.10753 of 2024(5) dt.28-05-2024 2/2 for the report from the official that whether work has been completed or not. The report has been submitted by the Chief Judicial Magistrate indicating that work has been completed and the said work is functional as per the report dated 14.03.2024 by Junior Engineer of the concerned Office.

5. Learned counsel for the State submits that other accused persons have also been granted bail by this Court vide order dated 20.02.2024 in Criminal Miscellaneous No. 9526 of 2024.

6. In this background, let the petitioner above named be granted bail after framing of charge, if the charge is not framed yet and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. X, Siwan in connection with Basantpur (Lakdinabiganj O.P.) P.S. Case No 451 of 2022 subject to the condition laid down under Section 437(3) of the Cr.P.C.
