JUSTICE ALOK KUMAR SINHA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 07-10-2025 The appellant has assailed the impugned order dated 19.11.2024 passed in CWJC No. 16464 of 2024.

From perusal of the lis sought in the CWJC No. 16464 of 2024, the appellant is entitled to mandamus only after due fulfilling mandatory ingredients namely approaching the concerned authority with certain grievance read with the right vested with the concerned person. The aforementioned general issue has been taken note of by the learned Single Judge while

Patna High Court L.P.A No.1267 of 2024(3) dt.07-10-2025 2/2 deciding CWJC No. 16464 of 2024. Therefore, no interference is called for. In fact, order of the learned Single Judge is supported by Hon'ble Supreme Court decision in the case of Bank of India & Ors. Vs. Muthyala Saibaba Suryanarayana Murthy & Anr. [Civil Appeal No. 3829 of 2025 arising out of SLP(C) No. 24400 of 2024] reported in 2025 SSC online SC 585.

3. Accordingly, the present LPA No. 1267 of 2024 stands disposed of.

4. Appellant is permitted to approach the concerned authority within a period of four weeks from the date of receipt of this order. In the event of filing such application or representation addressing grievance, the concerned authority is hereby directed to adjudicate his grievance within a period of three months from the date of receipt of such application of writ petition.
