The present petition has been preferred for the following reliefs:- (i) for a direction to the respondents concerned specially District Magistrate Aurangabad (Respondent no. 5) Deputy Development Commissioner, Aurangabad (Bihar) and Chief Executive Officer Jila Parishad Aurangabad (Bihar) (Respondent no. 9) to allot the

Patna High Court CWJC No.1860 of 2024(2) dt.02-07-2024 2/3 shop No. 20 area 15 x 10 = 150 square feet on favour of petitioner which situated at Rafiganj Dak Bangla District- Aurangabad on the basis of notice of settlement dated 24.03.2017 by office of Jila Parishad Aurangabad;

(ii) also for direction the respondent no.

D.D.C (Respondent no. 8) and the Chief Executive officer (Respondent no. 9) to recall the notice dated 27.09.2023;

(iii) and also for direction the respondent no. 7 i.e. D.I.G. vigilance department Patna to enquiry the matter of shop tender Rafiganj Dak Bangalw, the notice was published on 21.02.2017 and cancelled on 27.09.2023 by Chief Executive officer Jila Parishad Aurangabad (Bihar).

Learned Counsel appearing on behalf of the respondent no. 9, the Chief Executive Officer, Zila Parishad, Aurangabad submitted that after the bidding took place, considering the anomalies that occurred in the matter clearly showing some tacit understanding between the petitioner and the first bidder, the authorities decided to re-tender the matter.

4. He submits that the petitioner is free to once again appear in the bidding process and if he is successful, will be entitled for the allotment.

5. Learned Counsel for the petitioner submits that he
