The petitioner seeks bail in a case registered for the offence under Sections 302/120(B) of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing incriminating has been recovered from the conscious possession of the petitioner. Moreover, there is no eye witness to the alleged occurrence and the petitioner is nowhere involved in this case. The petitioner is rotting in judicial custody since 10.05.2018.

Patna High Court CR. MISC. No.82438 of 2019(3) dt.06-03-2020 2/2 Learned A.P.P. for the State has opposed the prayer for bail and submitted that there is direct allegation of assault by giving dagger blow on the vital part of the person of the deceased as a result of which he died. Considering the facts and circumstances of the case, this Court is not inclined to grant regular bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected.
