06-05-2024 Heard Sri Sharda Nand Mishra, learned counsel for the petitioner and Sri Arvind Kumar, learned Special P.P. for Vigilance Department.
2. The petitioner apprehends his arrest in a case registered for offence under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
3. The allegation against this petitioner is that he obtained appointment as Teacher on the basis of forged and fabricated Intermediate Mark-sheet and Certificate.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that at the time of appointment, petitioner furnished his all the educational qualification
Patna High Court CR. MISC. No.7945 of 2024(5) dt.06-05-2024 2/2 certificates and after due verification, he was appointed on the post of Teacher, but behind back without giving any notice or opportunity of hearing, the certificate and mark-sheet, furnished by the petitioner, have been declared to be forged and fabricated.
5. By way of referring to averment made in paragraph - 10 of the counter affidavit, learned Special P.P. for Vigilance Department submits that after due verification, the Intermediate mark-sheet and provisional certificate, submitted by this petitioner, were found to be of one Jitendra Kumar.
6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J.) anay U T
