Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bhorey P.S. Case No. 291 of 2019 for the offenses under Section30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 3.9.2019.

Considering the fact that the petitioner has no criminal antecedent and he has remained in jail since 3.9.2019, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the

Patna High Court CR. MISC. No.82152 of 2019(2) dt.18-12-2019 2/2 like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum- Special Judge (Excise), Gopalganj in connection with Bhorey P.S. Case No. 291 of 2019, subject to deposit of Rs. 50,000/- cash in the court below. The deposit of cash of Rs. 50,000/- shall abide by the final outcome of the pending criminal case.
