Petitioner apprehends arrest in connection with Kaji Mohamadpur P.S. Case No. 299 of 2019 registered for the offence under sections 498A/377 of the Indian Penal Code and sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case merely due to filing of a divorce case by the petitioner against the informant when she had left the matrimonial house and ignored the petitioner. As a matter of fact, it is the informant who does not want to live with this petitioner. She always used

Patna High Court CR. MISC. No.4309 of 2020(4) dt.13-02-2023 2/2 to maltreat, misbehave, abuse and assault the petitioner. On treatment she was diagnosed with mental problem. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistate, I, Muzaffarpur in connection with Mohamadpur P.S. Case No. 299 of 2019 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
