The petitioners are apprehending their arrest in a case registered under Sections 447, 385, 379/34 of the Indian Penal Code.

Allegation is that the petitioners and two unknown persons harvested the wheat crops of the informant, cultivated by him forcibly in the night on the point of pistol by saying that they have purchased the land.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.83499 of 2019(2) dt.17-12-2019 2/2 petitioners. The petitioners have falsely been implicated in the present case due to petty family dispute. There is title suit also pending between the parties. It is alleged that the accused persons forcibly harvested the crop of the informant. The said allegation is denied by the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Samho P.S. case No.07 of 2017, G.R. No.1145 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
