2. The petitioner is in custody since 25.04.2023 in connection with Surajgarha P.S. Case No. 138/2023 registered for the offence punishable under Sections 363/366 of the Indian Penal Code and Section 8/12 of the POCSO Act.

3. As per the prosecution case, the petitioner was caught with the victim girl.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the statement of the victim girl suggests that the petitioner had come to meet the victim girl.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VI cum Special Judge POCSO, Lakhisarai in connection with Surajgarha P.S. Case No. 138/2023.
