JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 05.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Buxar (Mufassil) P. S. case no. 158/2017 registered under section 10 of the Bihar Conduct of Examination Act, 1981. Petitioner was Center Superintendent and it is alleged that he as well as invigilator did not deposit seven copies of matric board examination. However, learned counsel for the petitioner drew my attention towards enquiry report which has been annexed along with FIR and submitted that enquiry team did not find any interpolation in the aforesaid copies and moreover, co-accused Pradeep Kumar Gupta, invigilator, has already been granted
Patna High Court Cr.Misc. No.19344 of 2018 (2) dt.05-04-2018 privilege of anticipatory bail by a coordinate bench of this court vide order dated 09.11.2017 passed in Cr. Misc. no. 53936/2017.
Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate V, Buxar in Buxar (Mufassil) P. S. case no. 158/2017 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
