====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-12-2025 Heard learned senior counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 61(2), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. As per F.I.R., on 04.05.2025 at 9:15 PM, while husband of informant was at his shop, in the meantime, one miscreant, by covering his face, came at the shop and shot dead husband of informant and fled away.
4. Learned senior counsel for the petitioner submits that name of the petitioner surfaced during investigation in the confessional statement of co-accused Mukesh Jha and Bipin
Patna High Court CR. MISC. No.86309 of 2025(2) dt.10-12-2025 2/2 Kumar Gupta. Even, during investigation, it has not come that this petitioner participated in the killing of the deceased. Petitioner is in custody since 08.05.2025. Chargesheet has been submitted.
5. Learned counsel for the informant opposes the prayer for bail.
6. Considering the nature of accusation and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Naugachia, Bhagalpur in connection with Naugachia P.S. Case No. 145 of 2025.
