Petitioner apprehends his arrest in connection with Motipur P.S. Case No.478 of 2018, registered for the offences punishable under Section 406, 420, 467, 468, 471, 120(B), 34 of the Indian Penal Code.

This is the second attempt on behalf of the petitioner inasmuch as earlier the bail application of the petitioner has been rejected by order dated 26.08.2019 passed in Cr. Misc. No.7794 of 2019.

Learned counsel appearing for the petitioner on earlier occasion withdrew his application after some argument when the Court was not inclined to grant anticipatory bail to this petitioner. Petitioner herein was petitioner No.4 in earlier bail application, i.e.

Patna High Court CR. MISC. No.82156 of 2019(2) dt.22-01-2020 2/2 Cr. Misc. No.7794 of 2019. Learned counsel for the petitioner submits that earlier there was some dispute between four petitioners and due to ill motive, other petitioners instructed learned counsel to withdraw the application on behalf of petitioner No.4 in earlier bail application.

On the other hand, learned counsel appearing for the State submits that the Court was not inclined to grant anticipatory bail to petitioner No.4 in earlier bail application and accordingly, learned counsel appearing for the petitioner No.4 sought permission to withdraw the application.

After having heard learned counsel for the parties and taking into consideration the fact that bail application of the petitioner was earlier rejected vide order dated 26.08.2019 in Cr. Misc. No.7794 of 2019 and no fresh material or development has been brought on record since rejection of earlier bail application of the petitioner. Accordingly, I am not inclined to grant anticipatory bail to the petitioner who has moved before this Court for the second time without having any further development and fresh material. Thus, the present application, i.e., Cr. Misc. No.82156 of 2019 is hereby rejected.
