JUSTICE PURNENDU SINGH ORAL ORDER 31-01-2024 Heard Mr. Sharda Nand Mishra, learned counsel appearing on behalf of the petitioners and Mr. Yogendra Kumar, learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in connection with Belaganj P.S. Case No. 479 of 2023 registered under Section 323, 341, 353, 504, 34 of the Indian Penal Code.

3. As per the allegation made in the FIR, the informant, who is the S.H.O. of Belaganj P.S., received information that a woman is being harassed in village pond. The petitioners have been named in the FIR along with other coaccused persons.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.1692 of 2024(2) dt.31-01-2024 2/2 petitioners submits that the allegation made against them is not sustainable and the same has been alleged due to enmity with the informant and the petitioners have been dragged in false case.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Considering the rival submission made on behalf of the parties, as well as, the nature of allegation made against the petitioners, the Court below is directed to release the petitioners on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Belaganj Case No. 479 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
