This application for anticipatory bail arises out of Digha P.S. Case No. 638 of 2018 for the offence punishable under Sections 420, 406, 467, 468 and 120B/34 of the Indian Penal Code.

It is alleged in the First Information Report that coaccused Kiran Devi had executed a sale deed in favour of the informant on 24.05.2018. When the informant started taking steps for mutation, he learnt that Kiran Devi had already executed sale deed in respect of the same land in favour of someone else. The petitioner had allegedly identified Kiran Devi in the sale deed.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.82754 of 2019(3) dt.19-06-2020 2/2 petitioner has submitted that Kiran Devi has been allowed anticipatory bail by the Court below after taking into account the compromise arrived at between the contesting parties. Considering the above submission and the facts and circumstances, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Patna, in Digha P.S. Case No. 638 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
