The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406/409/420 of the Indian Penal Code.

Allegation against the petitioner is that he was assigned work for completion of three government projects fully detailed in the F.I.R. On measurement, lesser than the required work was found to be done and one work was completely left out, whereas payment against all the work was already withdrawn by the petitioner.

Learned counsel for the petitioner submits that the petitioner is aged about 65 years having no criminal antecedent. I have gone through the case diary.

Patna High Court CR. MISC. No.3609 of 2020(6) dt.25-11-2020 2/2 Considering the nature of allegation of defalcation of public money, I am not inclined to enlarge the petitioner on anticipatory bail. Hence prayer is refused in connection with Chhatapur P.S. Case No. 214 of 2019.

The petitioner is directed to surrender within four weeks and pray for regular bail.
