Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Durgawati P.S. Case No. 274 of 2019, registered for the offences punishable under Sections 323/341/379/504/307/34 of the Indian Penal Code. According to FIR, the petitioner allegedly caused injury at the head of the informant with iron rod. The doctor has found head injury.

Learned counsel for the petitioner submits that there is no allegation of repetition of blow. The doctor has found simple injury on the head. There is case and counter case.

Since the petitioner had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
