JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2018 The Superintendent of police vide his letter no.806 dated 15.05.2018 has reported that the warrant of arrest against the prosecution witnesses could not be executed on account of laches of some police officials against whom action has already been taken. The Superintendent of police further reported that so far as witnesses are concerned, the notices upon witnesses have already been served and the witnesses shall be produced before the trial court on the appointed date.

It would appear that petitioner happens to be main assailant and earlier his prayer for bail was rejected. Therefore, in the aforesaid circumstance, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Awtar Nagar P.S.Case No.97 of 2015 in Session trial no. 145 of

Patna High Court Cr.Misc. No.20655 of 2018 (4) dt.20-06-2018 2/2 2016, pending in the court of learned Additional Session Judge-X, Saran at Chapra stands rejected.

However, the learned trial court must expedite the trail of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/ production of a copy of this order.
