The petitioner, who is the husband of late Gita Devi, an Anganwari Sevika, who died in harness, approached this Court for a direction to the respondents to pay him Rs. 4,00,000/- as ex-gratia payment in view of the Circular of the Government to compensate for such deaths.

Patna High Court CWJC No.25060 of 2019(2) dt.13-12-2019 2/3 For no apparent reason, the aforesaid Circular has not been given effect to in the case of the petitioner whose wife has died while working as Anganwari Sevika at the concerned Centre.

A representation also has been filed by the petitioner before the Principal Secretary, Social Welfare Department, Government of Bihar, Patna but till date it appears that it has fallen on deaf ears.

Under the aforesaid circumstances, the petitioner was left with no other alternative but to approach this Hon'ble Court.

The petitioner, under the aforesaid circumstances, is directed to make a fresh representation before the Principal Secretary, Social Welfare Department, Government of Bihar, Patna (Respondent No.1) within a period of three weeks, who on receipt of the same shall look into the claim of the petitioner, verify the facts and ascertain the liability of the Department to pay to the petitioner the ex-gratia

Patna High Court CWJC No.25060 of 2019(2) dt.13-12-2019 3/3 amount and if the claim of the petitioner is found to be tenable, pass an order and make provision for immediate payment of the same within a further period of four weeks thereafter.

With the aforesaid observation / direction, this petition stands disposed off.
