The petitioner is in custody since 05.11.2019 in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 246 of 2019 for the offence registered under Section 30 (a) of the Bihar Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession petitioner but from the empty land which does not belong to the present petitioner. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.81368 of 2019(2) dt.11-12-2019 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise, Buxar in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 246 of 2019.
