Petitioner, already in custody, seeks bail in connection with Mairwa PS Case No.41 of 2018 registered under Sections 420, 467, 468, 471, 472, 379, 414 and 120(B) of the Indian Penal Code as well as under Section 66(C) of the I.T. Act. Allegation in brief is that some youths are engaged in withdrawing money from the ATM by using SIM and PIN of other customers and the petitioner was also apprehended along with others and recovery was made of two mobiles and two ATM Cards.

Submission is that there is no allegation of withdrawing money by using ATM Card and others by using the PIN Number. The recovered ATM Cards and mobiles are his

Having considered the aforesaid facts and circumstances, petitioner Mithilesh Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Mairwa PS Case No.41 of 2018.
