2. Learned counsel for the BSFC submits that he had

Patna High Court MJC No. 4469 of 2024(11) dt.26-09-2025 2/3 issued a cheque in tune of Rs. 1,84,891.52/-(Rupees One Lakh Eighty Four Thousand Eight Hundred Ninety One and Fifty Two Paisa Only) for the rest amount of leave encashment of 120 days. Infact the BSFC had already paid leave encashment of 180 days and altogether BSFC had paid leave encashment of 300 days.

3. Learned counsel for the BSFC further submits that the original writ petitioner compulsory retired from service with effect from 27.03.1998 and the gratuity amount has been paid in 2003 itself. Thereafter pursuant to the direction of this Court the date of superannuation of the original writ petitioner was increased and he retired w.e.f 30.11.2011 and the original writ petitioner has received gratuity amount of Rs. 95,036/- and 6,08,135/- vide cheque no.302129 dated 30.05.2012 and the gratuity amount is linked with LIC and LIC is required to pay the interest, if it is entitled.

4. In view of the aforesaid, the contempt petition is disposed of with liberty to the petitioner to approach before the competent authority for interest on the gratuity amount, if so advised.
