Petitioner is in custody in connection with Banka (Barahat) P.S. Case No. 65 of 2016 for the offence under sections 394 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The name of the petitioner surfaced on the basis of confessional statement of co-accused. Counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. He submits that the co-accused on whose confessional the name of the petitioner surfaced, was granted bail in Cr. Misc. No. 20999 of 2016 vide order dated 30.6.2016.

Considering the aforesaid, let the petitioner, named

Patna High Court Cr.Misc. No.21924 of 2018(3) dt.17-05-2018 2/2 above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No. 65 of 2016 on the condition that bailors should be family members of the petitioner.
