2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 329(3), 329(4), 109, 303(2), 351(2), 351(3), 352 and 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per prosecution case, Petitioner No. 1 is alleged to have assaulted informant with butt of rifle and Petitioner No. 2 is order giver who is alleged to have instigated other coaccused persons to shoot the informant.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are innocent and have

Injuries allegedly caused by Petitioner No. 1 are simple in nature. It is further submitted that there is case and counter-case between the parties and case lodged by petitioners' side against the informant and others is earlier in point of time. Rest of the allegations are super-addition only to make the case grievous.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the aforesaid facts and circumstances, nature of injuries sustained by the injured and case and countercase between the parties, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdispur P.S. Case No. 306 of 2024, subject to condition as laid down under
