Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 3.4.2017 passed in Cr. Misc. No. 8915 of 2017. The case is under Section 394 and 412 of the IPC and there is recovery of Rs.39,800/- from the petitioner. Submission of the learned counsel for the petitioner is that he is in custody for about 20 months and up-till-now only four witnesses have been examined and the case is pending for examination of seven witnesses and the other co-accused from whom Rs.10,000/- have been recovered has been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 17.2.2017 passed in Cr. Misc. No.6936/2017 and order dated 17.5.2017 passed in Cr. Misc. No.19139 of 2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 1st, Vaishali at Hajipur in connection with Sessions Trial No.200 of 2017 arising out of Mahua P.S.Case no.286 of 2016, with condition that he will cooperate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
