2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 126(3), 115(2), 303(2), 110, 352, 351(2)/3(5) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, in brief, is that on 20.07.2024, while the informant was running his shop, all the petitioners alongwith co-accused Raj Kishore Das came and started abusing him and on protest by informant, he was assaulted with lathi, danda and iron rod. It is further alleged that when granddaughter and nephew of informant came to save

Patna High Court CR. MISC. No.743 of 2025(2) dt.10-02-2025 2/2 informant, they were also assaulted by accused persons and petitioner no. 2 committed theft of silver locket of informant's nephew.

4. Learned counsel for the petitioners submits that on account of quarrel between the parties, a free fight took place in which both sides sustained injury. There is case and counter case. There is no specific allegation of assault against these petitioners.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 486 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
