JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 20.11.2017, seeks bail in Giriak PS Case No. 390 of 2017 registered under Sections 395 and 397 of the IPC.

The allegation in brief is that some unknown miscreants committed dacoity in the house of the informant, looted cash, jewelry and other articles and later on golden tops, one of the looted items, was recovered from the possession of the petitioner and that too was identified in the identification parade. Learned Counsel for the petitioner submits that there was no description in the FIR regarding the jewelry and it is a common item and the petitioner is in custody since 20.11.2017. Whereas learned Counsel for the State submits that the looted golden top was identified by the family members, besides this the petitioner has seven criminal antecedents of similar nature. Having considered the aforesaid facts and circumstances the Court is not persuaded to grant bail to the petitioner. Accordingly the prayer for bail of the petitioner is rejected.
