2. Petitioner seeks regular bail in case registered for the offence punishable under Sections 304 (B) and 34 of the Indian Penal Code .

3 . It is a case of dowry death . Informant namely Jitendra Ram alleged that 3 years ago , marriage of his sister ( deceased) was solemnized with this petitioner and after some time of marriage , this petitioner along with other co-accused persons started torturing and harassing the deceased for demand of dowry and also threatened to kill her. It is further alleged that on 19.10.2023, informant got information that his sister died. Upon such information , informant reached there and saw that her sister was lying dead. 4. Learned counsel for the petitioner submits that this petitioner has falsely been implicated in this case merely because he happens to be the husband of the deceased. Though there is allegation of strangulation but no external injury has been found on the body of deceased. The family members of the deceased was informed about the death of deceased and they were also present in the cremation process but on the next date of occurrence , the family member of the deceased lodged the present case with ulterior motives. Informant is not an eye witness to the alleged occurrence . Allegation is general and omnibus against this petitioner. Petitioner never demanded dowry from the deceased or his family members. Petitioner claims clean antecedent. Petitioner is in custody since 21.08.2024 . Chargesheet has already been submitted. 5 .

Learned counsel for the State opposed the bail petition and submitted that this petitioner is husband of the deceased who died an unnatural death at her matrimonial house within seven years of marriage . Post mortem report reveals that there were external injuries on the body of deceased which were caused by hard and blunt object.

6. Considering the fact that the victim died an unnatural death at her matrimonial house within seven years of marriage , the prayer of petitioner for regular bail is rejected. (Prabhat Kumar Singh, J) Koushik/- U
