2. Petitioner seeks bail, who is in custody since 11.03.2024, in connection with Mohiuddin Nagar P.S. Case No. 338 of 2023, F.I.R. dated 11.12.2023 registered for the offences punishable under Section 395 of the Indian Penal Code.

3. Earlier the petitioner has moved before this Court for grant of bail in Cr. Misc. No. 82698 of 2024 but the same was rejected vide order dated 28.02.2025.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 11.03.2024 and the trial is not concluded as yet only charge has been framed against the

5. Learned Additional Public Prosecutor for the State, on the other hand, vehemently opposed the prayer for bail of the petitioner and submits that an amount of Rs. 1,62,000/- (Rs. One Lakh Sixty Two Thousand only) has been recovered from the house of the petitioner and apart from the aforesaid some looted ornaments were also recovered from the house of the petitioner as well as the petitioner carries twelve more cases other than the present one but fairly submits on the basis of paragraph-3 of the petition that out of twelve cases the petitioner is on bail in eight cases.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Sahpur Patory, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 338 of 2023, subject to the following conditions :-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient

(2) If the petitioner tampers with the evidence or the witness, in that case, the prosecution will be at liberty to move for cancellation of bail.

(3) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
