JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Belaganj P.S. Case No. 356 of 2019 registered for the offences punishable under Section 420 of the Indian Penal Code and Section 7 of Essential Commodities Act. As per FIR petitioner is said to be PDS dealer and on inquiry there was irregularity in distribution of articles and excess charge. It further appears that he is accused in one more case.

Submission of learned counsel for the petitioner is that Annexure-2 is the certificate given by Mukhiya and other officials that shows that there is no irregularity in the distribution and supply and petitioner has falsely been implicated.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.80811 of 2019(2) dt.21-01-2020 2/2 anticipatory bail on the ground that petitioner has criminal antecedent also.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

This application is, accordingly, dismissed.
